Artikel 1: Definities
In deze algemene voorwaarden wordt verstaan onder:
Opdrachtgever: de persoon of organisatie die de live illustratie opdracht heeft gegeven.
Illustrator: de persoon die de live illustraties uitvoert (jij als live illustrator).
Overeenkomst: de schriftelijke of mondelinge afspraak tussen de opdrachtgever en de illustrator voor het leveren van live illustratie diensten.
Evenement: het evenement waarvoor de live illustratie wordt uitgevoerd.
Artikel 2: Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op alle overeenkomsten tussen de illustrator en de opdrachtgever, tenzij schriftelijk anders is overeengekomen.
Artikel 3: Aanbieding en Overeenkomst
De offerte voor de live illustratie wordt op basis van de wensen van de opdrachtgever opgemaakt.
De optionele reservering blijft twee weken geldig na het ontvangen van de offerte, daarna moet er een akkoord worden gegeven op de offerte om de reservering te plaatsen.
De overeenkomst komt tot stand wanneer de opdrachtgever de offerte heeft goedgekeurd en de bevestiging heeft gegeven, hetzij mondeling, hetzij schriftelijk.
Artikel 4: Verplichtingen van de Illustrator
De illustrator zal de afgesproken datum het live illustreren met zorg en naar beste vermogen uitvoeren.
De illustrator is niet verantwoordelijk voor technische problemen of andere onvoorziene omstandigheden die buiten zijn/haar macht liggen en de uitvoering van de opdracht vertragen of verhinderen.
De illustrator is verplicht zich vooraf te informeren over de locatie, het evenement en alle nodige materialen en voorzieningen. (Bijvoorbeeld beschikbare tafel en stoel)
Artikel 5: Verplichtingen van de Opdrachtgever
De opdrachtgever dient tijdig alle benodigde informatie voor de live illustratie te verstrekken, zoals het thema, specifieke wensen en de locatie van het evenement.
De opdrachtgever zorgt voor de benodigde faciliteiten zoals werkplek, tafel en stoel en een verantwoordelijke werkomgeving.
De opdrachtgever is verantwoordelijk vooraf aan het events de illustrator te informeren of het event buiten plaats vindt. Als het event buiten plaats vind is de opdrachtgever veranderlijk voor een prettige werkomgeving. (Bijvoorbeeld bij een buiten event als het koud is verwarming faciliteren en bij warme temperaturen en volle zon een parasol)
De opdrachtgever is verantwoordelijk voor het betalen van de overeengekomen prijs, zoals gespecificeerd in de offerte.
Artikel 6: Prijs en Betaling
De prijs voor de live illustratie wordt vooraf afgesproken in de offerte en is afhankelijk van de duur of het aantal personen, de locatie en andere specifieke wensen.
Betaling dient plaats te vinden volgens de afgesproken betalingstermijn van 30 dagen, tenzij anders overeengekomen.
Artikel 7: Annulering
Annulering door de opdrachtgever dient schriftelijk te gebeuren. Bij annulering gelden de volgende voorwaarden:
Bij annulering tot 3 maanden voor het evenement worden er geen kosten in rekening gebracht.
Bij annulering binnen 3 maanden voor het evenement wordt 25% van het volledige bedrag in rekening gebracht.
Bij annulering binnen 30 dagen voor het event wordt 50% van het volledige bedrag in rekening gebracht.
Bij Annulering binnen 14 dagen voor het event wordt 75% van het volledige bedrag in rekening gebracht.
Bij annulering 48 uur voor het event wordt 100% van het volledige bedrag in rekening gebracht.
Bij annulering door de illustrator om welke reden dan ook, zal een volledige restitutie plaatsvinden, tenzij anders overeengekomen.
De illustrator zal een boeking alleen annuleren in het geval van overmacht en zal zich in alle tijden inspannen vervangen te regelen of een andere geschikte oplossing te vinden.
Artikel 8: Auteursrechten en Gebruik van Werk
De illustrator behoudt alle auteursrechten op de gemaakte illustraties, tenzij anders schriftelijk overeengekomen.
De opdrachtgever krijgt het recht om de illustraties te gebruiken voor het specifieke evenement waarvoor ze zijn gemaakt. Het commerciële gebruik van de illustraties zonder schriftelijke toestemming van de illustrator is niet toegestaan.
De illustrator mag foto’s van de gemaakte illustraties gebruiken voor promotionele doeleinden, zoals portfolio’s, social media en andere marketingdoeleinden, tenzij anders overeengekomen.
Artikel 10: Aansprakelijkheid
De illustrator is niet aansprakelijk voor schade veroorzaakt door overmacht, zoals technische storingen, slechte weersomstandigheden of andere onvoorziene omstandigheden.
De illustrator is aansprakelijk voor schade die het directe gevolg is van opzet of grove nalatigheid van de illustrator zelf.
Terms and Conditions for Live Illustration
Article 1: Definitions
In these general terms and conditions, the following definitions apply:
Client: the person or organization who has commissioned the live illustration.
Illustrator: the person performing the live illustrations (you as the live illustrator).
Agreement: the written or verbal arrangement between the client and the illustrator for the provision of live illustration services.
Event: the event for which the live illustration is being performed.
Article 2: Applicability
These general terms and conditions apply to all agreements between the illustrator and the client, unless explicitly agreed otherwise in writing.
Article 3: Offer and Agreement
1. The quotation for the live illustration will be prepared based on the client’s requirements.
2. An optional reservation remains valid for two weeks after receipt of the quotation. After this period, the quotation must be approved to confirm the reservation.
3. The agreement is concluded once the client has approved the quotation and provided confirmation, either verbally or in writing.
Article 4: Obligations of the Illustrator
1. The illustrator shall perform the live illustration on the agreed date with care and to the best of their ability.
2. The illustrator is not responsible for technical problems or other unforeseen circumstances beyond their control that delay or prevent the execution of the assignment.
3. The illustrator is obliged to gather information in advance regarding the location, event, and all necessary materials and facilities (e.g., available table and chair).
Article 5: Obligations of the Client
1. The client must provide all necessary information for the live illustration in a timely manner, such as the theme, specific requests, and the event location.
2. The client shall provide the necessary facilities, such as a workspace, table, chair, and a suitable working environment.
3. The client is responsible for informing the illustrator in advance if the event takes place outdoors. If the event is outdoors, the client is responsible for ensuring a comfortable working environment (e.g., providing heating if it is cold, or a parasol if it is sunny and hot).
4. The client is responsible for paying the agreed price as specified in the quotation.
Article 6: Price and Payment
1. The price for the live illustration is agreed upon in advance in the quotation and depends on the duration, number of participants, location, and other specific requirements.
2. Payment must be made according to the agreed payment term of 30 days, unless otherwise agreed in writing.
Article 7: Cancellation
1. Cancellations by the client must be made in writing. The following conditions apply:
Cancellation up to 3 months before the event: no costs will be charged.
Cancellation within 3 months of the event: 25% of the total fee will be charged.
Cancellation within 30 days of the event: 50% of the total fee will be charged.
Cancellation within 14 days of the event: 75% of the total fee will be charged.
Cancellation within 48 hours of the event: 100% of the total fee will be charged.
2. If the illustrator cancels for any reason, a full refund will be provided, unless otherwise agreed.
3. The illustrator will only cancel a booking in case of force majeure and will always make efforts to arrange a replacement or find another suitable solution.
Article 8: Copyright and Use of Work
1. The illustrator retains all copyrights to the illustrations created, unless otherwise agreed in writing.
2. The client is granted the right to use the illustrations solely for the specific event for which they were created. Commercial use of the illustrations without the written consent of the illustrator is not permitted.
3. The illustrator may use photos of the created illustrations for promotional purposes, such as portfolios, social media, and other marketing purposes, unless otherwise agreed.
Article 10: Liability
1. The illustrator is not liable for damages caused by force majeure, such as technical failures, adverse weather conditions, or other unforeseen circumstances.
2. The illustrator is liable for damages that are a direct result of intent or gross negligence on the part of the illustrator.
